These Terms of Service set out the terms on which NXTFlow Supplies sells products through this website.

Please read these Terms carefully before placing an order.

By placing an order with us, you agree to these Terms. Nothing in these Terms affects any statutory rights that you may have as a consumer.

In these Terms, references to “NXTFlow Supplies”, “NXTFlow”, “we”, “us” or “our” mean the business operating NXTFlow Supplies.

References to “you” or “your” mean the person or business placing an order with us or using our website.

2. Who These Terms Apply To

We sell products to both consumers and trade or business customers.

A consumer is an individual purchasing goods wholly or mainly for purposes outside their trade, business, craft or profession.

A business customer is a person, sole trader, partnership, company or other organisation purchasing goods wholly or mainly for business purposes.

Certain statutory protections referred to in these Terms apply specifically to consumers. Separate provisions for business and trade customers are set out below.

3. Our Products

We supply plumbing, heating and trade products including fittings, valves, sealants, consumables, heating system products, chemicals, components and related products.

We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.

Product images are for illustrative purposes. Packaging, labelling or appearance may occasionally differ from the images displayed, provided that this does not materially change the product supplied or its advertised specification.

We will not knowingly substitute a materially different product without your agreement.

If you require a product for a particular application, system or specification and are unsure whether it is suitable, please contact us before ordering.

4. Product Compatibility and Installation

You are responsible for checking product dimensions, connections, specifications and compatibility with your intended system before installation, unless you have specifically asked us for advice about a particular purpose and reasonably relied upon that advice.

Some plumbing, heating and related products must be installed, commissioned or serviced by a suitably competent or appropriately qualified person.

Where applicable, products must be installed and used in accordance with:

  • the manufacturer's instructions;
  • applicable laws and regulations;
  • relevant safety requirements; and
  • recognised industry practice.

We are not responsible for damage caused by incorrect installation, misuse, unauthorised modification, failure to follow manufacturer instructions or use of a product for a purpose for which it was not designed.

Nothing in this section limits your rights where a product is faulty, misdescribed, unsafe or otherwise does not comply with the contract.

5. Chemicals, Sealants and Similar Products

Certain products sold by NXTFlow Supplies may include chemicals, liquids, sealants, compounds, cleaning products or other products requiring particular handling, storage or use.

You must follow all manufacturer instructions, warning labels, safety information and, where supplied, safety data information.

You are responsible for ensuring that a product is suitable for your intended application before opening or using it, except where you have reasonably relied on advice provided by us regarding a particular purpose.

Some products may also be subject to transport or courier restrictions.

6. Prices

All prices are displayed in pounds sterling unless stated otherwise.

Any applicable taxes, delivery charges or other charges will be clearly shown before you place your order.

We may change our prices at any time, but changes will not affect an order that we have already accepted.

Despite our reasonable efforts, it is possible that a product may occasionally be incorrectly priced.

If we discover a pricing error before accepting your order, we will contact you and give you the option of purchasing the product at the correct price or cancelling the order.

If the pricing error is obvious and could reasonably have been recognised as an error, we may cancel the order and refund any amount you have already paid.

7. Promotions and Discount Codes

From time to time we may offer discount codes, promotional prices or other special offers.

Promotions may be subject to additional conditions, including:

  • expiry dates;
  • minimum order values;
  • exclusions;
  • limits on the number of uses; or
  • restrictions on combining promotions.

Unless stated otherwise, promotional codes have no cash value.

We reserve the right to refuse or cancel the use of a discount code where we reasonably believe it has been used fraudulently, abusively or contrary to the terms of the promotion.

This does not affect your statutory rights.

8. Placing an Order

When you place an order through our website, you are making an offer to purchase the products contained in that order.

After placing your order, you may receive an automatic order confirmation or acknowledgement.

An automatic acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

A contract between you and NXTFlow Supplies is normally formed when we accept your order and confirm that the goods are being dispatched, unless we expressly confirm acceptance earlier.

9. Our Right to Refuse or Cancel an Order

We may reasonably refuse or cancel an order before dispatch where, for example:

  • the product is unavailable;
  • there has been an obvious pricing or product-information error;
  • we are unable to obtain authorisation for payment;
  • we reasonably suspect fraud or misuse;
  • delivery to the requested address is not possible;
  • a product is subject to legal, safety or transport restrictions;
  • an order exceeds reasonable quantity restrictions; or
  • accepting the order would require us to break the law.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

We will not cancel an accepted consumer order in a way that removes rights you have under applicable consumer law.

10. Payment

Payment must be made using one of the payment methods available at checkout.

You confirm that you are authorised to use the payment method provided.

Your order may be subject to fraud prevention and payment verification checks.

We may delay dispatch while reasonable payment or security checks are completed.

11. Delivery

Available delivery options, charges and estimated delivery times will be shown on our website or during checkout.

Any delivery or dispatch times stated on the website are estimates unless we expressly agree a guaranteed delivery date with you.

We will take reasonable steps to dispatch and deliver orders within the stated timeframe.

Delays may occasionally occur because of matters outside our reasonable control, including courier disruption, severe weather, transport disruption or other exceptional circumstances.

If there is a significant delay, please contact us.

Nothing in these Terms limits any rights a consumer may have where goods are delivered late or are not delivered.

12. Delivery Address

You are responsible for providing a complete and accurate delivery address.

Please check your delivery information carefully before submitting your order.

If you realise that an address is incorrect, contact us as quickly as possible.

We cannot guarantee that an address can be changed once an order has been processed or dispatched.

Additional reasonable delivery costs caused solely by incorrect information supplied by you may be charged where permitted by law.

13. Risk During Delivery

Where you are purchasing as a consumer and we arrange delivery, the goods remain at our risk until they come into your physical possession, or the possession of another person identified by you to receive them.

If you independently arrange your own carrier and that carrier was not offered by us, responsibility may pass at an earlier point as provided by law.

14. Missing Deliveries

If your tracking information shows that an order has been delivered but you have not received it, please contact us as soon as reasonably possible.

We may ask you to check safe places, neighbouring properties or information provided by the courier while we investigate.

Where we arranged delivery, the fact that a courier has lost or misplaced a parcel does not by itself remove any legal responsibility we have to you.

15. Your Right to Cancel an Online Consumer Order

If you purchase from us as a consumer, you will normally have a legal right to cancel a qualifying online purchase without giving a reason.

For most goods, you have 14 days after the day on which you receive the goods to tell us that you wish to cancel.

Where an order contains multiple products delivered separately, the cancellation period may run from receipt of the final item.

After informing us that you wish to cancel, you normally have a further 14 days to return the goods.

16. Our Additional 30-Day Returns Policy

In addition to applicable statutory cancellation rights, NXTFlow Supplies offers an additional 30-day returns policy on eligible products.

Our voluntary 30-day policy may have conditions relating to the condition, use, installation and packaging of returned products.

These additional conditions do not reduce any statutory consumer rights.

17. Return Costs

For an ordinary change-of-mind return, you may be responsible for the direct cost of returning the goods where permitted by law and where you have been informed of this requirement.

Where goods are faulty, damaged on arrival, incorrect or otherwise supplied in breach of contract, we will deal with reasonable return costs in accordance with your legal rights and our Returns & Refund Policy.

18. Faulty Goods and Consumer Rights

If you are purchasing as a consumer, goods supplied by NXTFlow Supplies must meet the requirements of applicable UK consumer law.

This includes requirements that goods are, where applicable:

  • of satisfactory quality;
  • fit for their usual purpose;
  • fit for a particular purpose where you have made that purpose known to us and reasonably relied on us;
  • as described; and
  • supplied in accordance with other applicable contractual requirements.

If goods do not meet the required standards, you may have legal rights to reject the goods, obtain a repair or replacement, receive a price reduction or obtain a refund, depending on the circumstances.

Where the statutory short-term right to reject applies, consumers will normally have up to 30 days to exercise that right.

Nothing in these Terms or our Returns & Refund Policy is intended to exclude or restrict these rights.

19. Damaged or Incorrect Goods

Please inspect your order after delivery.

If an item arrives damaged, you receive an incorrect product, or something appears to be missing, please contact us as soon as reasonably possible at:

Where possible, please provide your order number and photographs of the product and packaging.

Prompt notification can help us investigate delivery damage with the courier, but failing to report a problem immediately does not remove statutory rights you may have.

20. Manufacturer Warranties

Certain products may be supplied with a manufacturer's guarantee or warranty.

Any manufacturer's warranty is additional to, and does not replace, statutory rights you may have against NXTFlow Supplies as the retailer.

Where appropriate, we may assist you in providing information required for a manufacturer's warranty claim.

21. Business and Trade Customers

If you purchase goods wholly or mainly for purposes relating to your trade, business, craft or profession, you are purchasing as a business customer.

Consumer-specific cancellation rights and remedies will not generally apply to those purchases.

Our voluntary returns arrangements may still apply where stated in our Returns & Refund Policy.

Business customers are responsible for satisfying themselves that products are suitable for their intended commercial application, specification and installation requirements.

Where a product is ordered using a manufacturer's part number, specification or other technical information supplied by the business customer, the business customer is responsible for checking that the product ordered is the product required.

Nothing in this section excludes liability for goods that we have incorrectly supplied or materially misdescribed.

22. Liability to Consumers

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable.

If you use products purchased as a consumer for commercial or business purposes, we are not responsible for business losses such as loss of profit, loss of revenue, loss of business or loss of business opportunity to the extent permitted by law.

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • rights and liabilities which cannot legally be excluded or restricted.

23. Liability to Business Customers

If you are a business customer, then to the fullest extent permitted by law:

We will not be liable for indirect or consequential losses, or for loss of profit, revenue, business, anticipated savings, contracts, goodwill or business opportunity arising from an order.

Subject to liabilities which cannot legally be excluded or limited, our total liability arising from or in connection with an individual order will not normally exceed the amount paid or payable to us for that order, except where such a limitation would be unlawful or unreasonable.

Nothing in these Terms excludes or restricts liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability which cannot lawfully be excluded or restricted.

24. Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform an obligation where the delay or failure results from circumstances genuinely outside our reasonable control.

This may include significant transport disruption, extreme weather, fire, flood, industrial action affecting third parties, widespread telecommunications failure or other exceptional events.

Where such an event affects an order, we will take reasonable steps to minimise the effect and keep you informed where appropriate.

Nothing in this section removes any statutory consumer rights relating to delayed or failed delivery.

25. Website Availability

We aim to keep our website available and functioning correctly, but we do not guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend or restrict access for maintenance, security, updates or circumstances outside our reasonable control.

This does not affect any contract already formed for the purchase of goods.

26. Acceptable Use of Our Website

You must not misuse our website.

In particular, you must not knowingly:

  • introduce viruses, malicious software or harmful code;
  • attempt to gain unauthorised access to our website, server or systems;
  • interfere with the normal operation or security of the website;
  • use automated systems to abuse our website or checkout;
  • submit fraudulent orders or payment information; or
  • use the website for unlawful purposes.

We may restrict access where we reasonably believe this is necessary to protect our customers, systems or business.

27. Intellectual Property

The content of the NXTFlow Supplies website, including our branding, graphics, text, layouts and original photographs or designs, is owned by us or used with the permission of the relevant rights holder.

Manufacturer names, trademarks, product photographs and logos remain the property of their respective owners.

You may use the website for ordinary personal or business purchasing purposes.

You must not reproduce, commercially exploit or systematically copy our original website content without permission unless the law allows you to do so.

28. Third-Party Services and Links

Our website may contain links to third-party websites or use third-party services, including payment, delivery and technology providers.

We are not responsible for the content of independent third-party websites that we do not control.

Your use of a third-party service may also be subject to that provider's own terms and privacy practices.

Nothing in this section affects our obligations to you in relation to products you purchase directly from NXTFlow Supplies.

We process personal information in accordance with our Privacy Policy.

Our website may also use cookies and similar technologies as explained through our cookie information and cookie preferences.

30. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.

The Terms that apply to an order will generally be the version in force when that order is placed.

Changes made after an order has been accepted will not retrospectively alter that contract unless required by law or expressly agreed with you.

31. If Part of These Terms Is Invalid

If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions will continue to apply.

32. Delayed Enforcement

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

33. Governing Law — Consumers

If you are a consumer, these Terms are governed by the laws applicable to your contract.

Where English law applies, these Terms are governed by the law of England and Wales.

Nothing in these Terms deprives consumers in Scotland, Northern Ireland or elsewhere in the United Kingdom of any mandatory protections available to them under applicable law or prevents them from bringing proceedings in a court available to them under applicable rules.

34. Governing Law — Business Customers

If you are a business customer, these Terms and any dispute or claim arising from them are governed by the law of England and Wales.

Subject to any rights that cannot legally be restricted, the courts of England and Wales will have exclusive jurisdiction in relation to disputes with business customers.

We want to resolve problems fairly and promptly.
